These Terms of Use (the “Terms”) are an agreement between you and Kharoshka Mikita (“Developer”, “we”, “us”), an individual developer based in the Republic of Belarus, covering the mobile application AI Captions Maker (the “App”). By downloading or using the App you accept these Terms. If you do not accept them, do not use the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, sell, rent, sublicense or redistribute the App, reverse engineer it except to the extent the law expressly allows, or remove any notice it contains.
The App transcribes the speech in a video you choose, times the words, draws captions over the video in a style you pick or build, and writes those captions into a new video file that you can share. Recognition normally runs on your device; the accuracy of the result depends on the recording, the language and the background noise, and it will not always be perfect. Every line can be corrected by hand, and that is part of how the App is meant to be used.
The videos you import, the transcripts produced from them and the styles you build remain yours. We claim no ownership of them and no license to them. We never receive them: they stay in the App's storage on your device, as described in the Privacy Policy.
You are responsible for having the right to use the footage and the audio you caption, including any music, and for what you publish. Do not use the App on material you have no right to use.
Without any subscription you can import videos, have them transcribed and timed, edit every caption, place and resize them, build your own styles, and preview any of the 28 styles over your own footage. Exporting with the three free styles is included.
A Captions Pro subscription is required to export a video using any of the premium styles or a style you built yourself. It also covers every style added to the App later.
Captions Pro is offered as a weekly plan and a yearly plan. The prices shown inside the App are the ones that apply to your App Store region, in your local currency, and they are shown before you confirm anything. Where a free trial is offered, its length is shown on the same screen; a trial is available once per Apple Account, and beginning a trial starts the subscription at the end of it unless you cancel first.
The App needs a compatible iPhone running iOS 17.6 or later, permission to recognise speech, and enough free storage for the recognition model and your exports. The first recognition downloads a model of roughly 145 MB over the network. You are responsible for your device, your data plan and the storage the App uses.
Do not use the App to create, caption or distribute material that is unlawful, that infringes someone else's rights, that harasses or defames, or that you are otherwise not permitted to publish. Do not attempt to interfere with the App, to circumvent the subscription, or to use it in a way that breaks the App Store Terms of Service.
The App uses Apple's App Store for payments, Apphud to manage subscription state, Mixpanel for usage analytics, and downloads its recognition model from Hugging Face. Their terms govern their own services. We are not responsible for those services being available, and their behaviour is outside our control.
The App, its interface, its caption styles and its name are owned by the Developer and protected by copyright and other laws. The fonts bundled with the App are used under their respective licenses and remain the property of their authors. Nothing in these Terms transfers any of that to you beyond the license in section 1.
The App is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that recognition will be accurate, that the App will be uninterrupted or error-free, or that it will meet your requirements. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, the Developer is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data or lost footage, arising out of or relating to your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for it in the twelve months before the claim arose. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.
You agree to indemnify and hold the Developer harmless from any claim arising out of the content you caption or publish with the App, or out of your breach of these Terms.
These Terms apply until terminated. They end automatically if you stop using and delete the App, and we may terminate them if you breach them. Sections 8 through 11 survive termination.
These Terms are governed by the laws of the Republic of Belarus, without regard to its conflict-of-law rules. This does not deprive you of the protection of mandatory consumer law in your country of residence.
If these Terms change, the date at the top of this page changes with them, and the new version is published here. Continuing to use the App after that means you accept the new version.
