These Terms of Use (the “Terms”) govern your use of the mobile application Fire TV: Firestick Remote (the “App”), provided by Kharoshka Mikita (“Developer”, “we”, “us”, or “our”), an individual developer based in the Republic of Belarus. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes on Apple-branded devices that you own or control, in accordance with these Terms and the Apple Media Services Terms and Conditions (including the standard “Licensed Application End User License Agreement”, or “Apple Standard EULA”). Where these Terms conflict with the Apple Standard EULA, these Terms apply to the extent permitted.
The App is a remote-control utility that lets you connect to and control compatible Amazon Fire TV devices on your local network, launch apps on those devices, and — using its IPTV feature — organise and play media from playlists that you provide. The App does not include, host, or supply any TV channels, streams, or media content of its own (see Section 7).
The App is free to download and includes both free and paid (“Premium”) functionality.
Premium features are unlocked through an auto-renewable subscription. We offer plans of different lengths, and some plans may include a free trial.
The plans available to you, the duration and price of each, and any free trial and its length, are shown in the App and on the App Store before you confirm your purchase. Available plans, prices, and trial offers may vary by region and change over time.
Subscriptions are sold and processed by Apple. Purchases, renewals, cancellations, and refund requests are handled by Apple in accordance with the Apple Media Services Terms and Conditions. We do not process payments and cannot issue refunds directly; refund requests may be submitted to Apple.
We use a third-party provider (Apphud) to manage subscriptions, validate purchases and measure performance. Some device and subscription data is processed for these purposes, and — only with your permission — your device’s advertising identifier may be used to measure our advertising, as described in our Privacy Policy.
The App requires a compatible Amazon Fire TV device on the same local Wi-Fi network as your iPhone or iPad, and the necessary network permissions. You are responsible for your own internet and network connection, your Fire TV device, and any data charges. You agree to use the App only for lawful purposes and in compliance with these Terms and all applicable laws.
You agree not to: (a) use the App for any unlawful purpose or to access, store, or distribute content you are not authorised to access; (b) reverse engineer, decompile, or attempt to derive the source code of the App, except to the extent permitted by law; (c) interfere with or disrupt the App or any networks or devices; or (d) resell, rent, or commercially exploit the App.
The App is an independent, third-party utility. It is not affiliated with, endorsed by, sponsored by, or otherwise associated with Amazon.com, Inc. or its affiliates, nor with any content or streaming provider. “Amazon”, “Fire TV”, “Fire TV Stick”, and “Firestick” are trademarks of Amazon.com, Inc. or its affiliates. Any other trademarks, service marks, and trade names are the property of their respective owners and are used for identification and compatibility purposes only.
The App does not provide, host, generate, or supply any media, channels, or streams. The IPTV feature is a player that lets you add and organise playlists and streams that you obtain from third parties of your own choosing. You are solely responsible for the sources you add and the content you access, and for ensuring that you have the legal right to access and view that content and that your use complies with all applicable laws and any third-party terms.
We do not control, verify, endorse, or assume any responsibility for third-party content, its availability, legality, accuracy, or quality. Any dispute regarding third-party content is between you and the relevant content provider.
The App and its original content, features, design, and functionality are and remain the exclusive property of the Developer and are protected by applicable laws. These Terms do not grant you any rights in our trademarks or branding.
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with any particular device, or that it will work with any specific Fire TV device or third-party service. To the maximum extent permitted by law, this includes any statutory warranties that can lawfully be excluded.
To the maximum extent permitted by applicable law, in no event will the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of or inability to use the App. To the maximum extent permitted by law, the Developer’s total liability for all claims relating to the App will not exceed the greater of (a) the amount you paid for the App or the subscription in the twelve (12) months before the event giving rise to the claim, or (b) USD 10. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
You agree to indemnify and hold harmless the Developer from any claims, damages, liabilities, and expenses arising out of your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party (including in connection with content you access through the IPTV feature).
These Terms apply while you use the App. We may suspend or terminate your access to the App or its features if you breach these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including Sections 6–11 and 13–14) will survive.
The following applies because the App is distributed through Apple’s App Store:
These Terms are governed by the laws of the Republic of Belarus, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in these Terms limits any mandatory statutory rights you may have as a consumer.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and post the new version at the same location. Your continued use of the App after an update constitutes acceptance of the revised Terms.
